Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Influex platform ("Platform") operated by Influex ("we", "us", or "our") at getinfluex.com.

By creating an account or using the Platform, you confirm that you are at least 18 years old, have read these Terms, and agree to be bound by them. If you are using the Platform on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Platform Description

Influex is a two-sided marketplace that connects D2C brands ("Brands") with micro-creators ("Creators") for the purpose of influencer marketing campaigns. The Platform facilitates:

  • Creator discovery and profile browsing
  • Campaign creation, management, and applications
  • Direct messaging between brands and creators
  • Collaboration management and milestone tracking
  • Secure payments via Razorpay

Influex is a platform intermediary. We do not create content, run campaigns, or guarantee campaign outcomes.

3. Account Registration

To use the Platform, you must:

  • Provide accurate and complete registration information
  • Keep your account credentials confidential
  • Notify us immediately of any unauthorised access to your account
  • Not create multiple accounts or share accounts with others
  • Not impersonate any person or entity

You are responsible for all activity that occurs under your account. We reserve the right to terminate accounts that violate these Terms.

4. Brand Terms

4.1 Campaign Conduct

As a Brand, you agree to:

  • Provide accurate and complete campaign briefs
  • Treat creators professionally and respectfully
  • Pay agreed amounts on time via the Platform's payment system
  • Not request unpaid work or excessive revisions beyond agreed scope
  • Not approach creators outside the Platform to avoid payment obligations

4.2 Prohibited Campaigns

You may not create campaigns that involve:

  • Illegal products or services
  • Adult content, gambling, or tobacco
  • Misleading claims or deceptive advertising
  • Content that discriminates on the basis of religion, caste, gender, or ethnicity
  • Fake engagement, review manipulation, or astroturfing

5. Creator Terms

5.1 Content Standards

As a Creator, you agree to:

  • Only apply to campaigns relevant to your actual audience and niche
  • Deliver content that meets the agreed brief and quality standard
  • Disclose paid partnerships as required by ASCI guidelines and applicable law
  • Not submit plagiarised, AI-generated without disclosure, or fake content
  • Maintain accurate follower and engagement data on your profile

5.2 Profile Accuracy

You must not misrepresent your follower count, engagement rate, or audience demographics. Accounts found to have artificially inflated metrics will be suspended and any pending payouts forfeited.

6. Payments and Commission

6.1 Payment Processing

All payments on the Platform are processed via Razorpay. By using the payment features, you also agree to Razorpay's terms of service.

6.2 Platform Commission

Influex charges a 15% platform commission on all campaign payments. This commission is deducted automatically from the payment amount before the creator receives their payout.

Example: If a brand pays ₹10,000 for a campaign, the creator receives ₹8,500 and Influex retains ₹1,500 as commission.

6.3 Refunds and Disputes

Payments are held in escrow until campaign milestones are marked as completed. In the event of a dispute:

  • Either party may raise a dispute through the Platform within 7 days of delivery
  • Influex will review the brief, submitted content, and communications
  • Our decision on disputes is final and binding
  • Refunds, if applicable, are processed within 7–10 business days via Razorpay

6.4 Payouts

Creator payouts are processed after campaign completion and dispute resolution period. Payouts are made to the bank account or UPI ID linked to your Razorpay account. Influex is not responsible for delays caused by Razorpay or your bank.

7. Intellectual Property

7.1 Content Ownership

Creators retain ownership of the content they create. By delivering content through the Platform, Creators grant the Brand a license to use the content as specified in the campaign brief (e.g., usage rights, exclusivity period, platforms).

7.2 Platform Content

All Platform features, design, code, trademarks, and branding are owned by Influex. You may not copy, reproduce, or use them without written permission.

7.3 User Content Licence

By uploading content to the Platform (profiles, campaign materials, messages), you grant Influex a non-exclusive, worldwide licence to display and use that content solely for the purpose of operating the Platform.

8. Prohibited Conduct

You may not use the Platform to:

  • Circumvent Platform payments by transacting with matched users outside Influex
  • Harass, threaten, or abuse other users
  • Upload malware, spam, or phishing content
  • Scrape or extract data from the Platform using automated tools
  • Attempt to reverse engineer, hack, or disrupt the Platform
  • Create fake reviews, fake engagement, or fake profiles
  • Violate any applicable Indian or international law

Violation of these rules may result in immediate account suspension, forfeiture of pending payouts, and legal action where applicable.

9. Account Suspension and Termination

We may suspend or terminate your account if you:

  • Violate these Terms or our community standards
  • Engage in fraudulent activity
  • Receive multiple substantiated complaints from other users
  • Provide false information during registration

You may close your account at any time by contacting hello@getinfluex.com. Pending obligations (active campaigns, outstanding payments) must be resolved before account closure.

10. Disclaimers and Limitation of Liability

The Platform is provided "as is" without warranties of any kind. We do not guarantee:

  • Campaign outcomes or ROI for brands
  • A minimum number of brand opportunities for creators
  • Uninterrupted or error-free service

To the maximum extent permitted by law, Influex's total liability for any claim arising from use of the Platform is limited to the fees you paid to us in the 3 months preceding the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including loss of revenue, loss of data, or reputational harm.

11. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.

Before initiating legal proceedings, you agree to contact us at hello@getinfluex.com and attempt to resolve the dispute informally within 30 days.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify registered users via email at least 14 days before the changes take effect, and update the "Last updated" date at the top of this page.

Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
